Electronic Consent Disclosure
This Electronic Consent Disclosure ("E-Consent") governs your agreement to receive required records and communications electronically from LOANS BY KRADEVIC LLC, loansbykradevic.com, participating providers, and applicable service partners.
1. Consent to Electronic Delivery
By selecting consent checkboxes, submitting online forms, or otherwise indicating agreement electronically, you consent to receive records and disclosures electronically rather than in paper form, except where paper is required by law or specifically requested and available. Your consent applies to the categories of records listed in this disclosure and may include future records related to the same relationship.
2. Covered Communications
- Privacy notices, policy updates, and legal disclosures
- Application acknowledgments and transaction-related notices
- Provider-required pre-contract and contract disclosures
- Adverse action notices where applicable
- Operational service notices and account communications
- Customer support and compliance correspondence
Covered records may be provided in HTML, PDF, email message body, secure web portal message, or other electronic formats permitted by law.
3. System and Access Requirements
To access electronic records, you must maintain internet access, a current browser, a valid email account, and the ability to open and retain electronic files, including PDF documents. You are responsible for your own hardware, software, internet connection, and data charges.
If your system no longer satisfies these requirements, you must notify us promptly and discontinue electronic consent where appropriate.
4. Updating Contact Information
You must keep your contact details, including email and mailing address, current and accurate. Failure to update contact information may prevent timely receipt of disclosures and could affect processing of your requests.
5. Paper Copies and Fees
You may request paper copies of certain records where legally required or operationally available. We may apply reasonable processing or mailing fees where permitted by law and disclosed in advance of fulfillment. Availability and delivery timeframes may vary by record type and provider process.
6. Withdrawal of Consent
You may withdraw e-consent by contacting support@loansbykradevic.com. Withdrawal may delay processing or limit access to services where electronic delivery is operationally required. Withdrawal does not affect validity of records already delivered electronically, and does not automatically terminate agreements with providers.
7. Record Retention Recommendation
You should download or print all disclosures, agreements, and notices for your own records. Retaining copies supports dispute resolution, payment tracking, and legal compliance in the event records are no longer available online.
8. Federal and State Law Compliance
This disclosure is intended to satisfy applicable electronic disclosure requirements, including where relevant the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act), the Uniform Electronic Transactions Act (UETA), and corresponding state requirements. To the extent of any legal conflict, mandatory law controls.
9. Contact Information
Questions regarding this E-Consent can be sent to support@loansbykradevic.com, (970) 406-7881, or 12029 W Center Ave, Lakewood, CO 80228-2901.
10. Delivery Failures and Undeliverable Notices
If electronic messages are returned as undeliverable, blocked by filtering controls, or otherwise inaccessible due to outdated contact information, we may treat delivery obligations as satisfied where legally permissible and where records were made available through an alternate electronic channel. You remain responsible for updating contact data and monitoring designated communication channels.
11. Consent Duration and Scope Expansion
Your e-consent remains in effect for the duration of your relationship with our services and may apply to future communications related to substantially similar products, service operations, compliance notices, and legal disclosures unless withdrawn in accordance with this disclosure. Separate providers may require separate consent acknowledgments under their own legal frameworks.
12. Electronic Signatures and Record Admissibility
You acknowledge that electronic signatures, digital acknowledgments, and electronic records may have the same legal effect as handwritten signatures and paper records, subject to applicable law. You agree not to contest enforceability solely because a record or signature is in electronic form, except where mandatory law provides otherwise.
13. Language and Accessibility Notice
Where translations are provided, the controlling legal version may be the primary language identified in governing disclosures unless mandatory law requires otherwise. If you require accessibility accommodations to review records, contact support@loansbykradevic.com and we will provide reasonable assistance consistent with legal requirements and operational capability.
14. Consent Revocation Consequences
If you revoke electronic consent, certain features may become unavailable or delayed where electronic delivery is required for lawful operation, identity verification, fraud prevention, or provider integration workflows. Revocation does not invalidate prior records, disclosures, or agreements previously accepted electronically.
15. Third-Party Provider Communications
Participating providers may issue their own electronic disclosures, agreements, and notices under separate legal terms. Your consent to our electronic delivery framework does not replace provider-specific consent requirements, and you may be required to provide additional electronic acknowledgments directly to providers.
16. Timing of Electronic Delivery
Electronic records may be delivered immediately, in batched intervals, or upon trigger events depending on record type and legal requirements. Delivery timestamp, system logs, and technical availability records may be used as evidence of delivery and access opportunities to the extent permitted by law.
17. Record Integrity and Alteration Controls
We implement controls intended to preserve record integrity and reduce unauthorized alteration risk. Users should promptly report suspected tampering, mismatched disclosures, or delivery anomalies. Verification and remediation steps may include regenerated records, supplemental notices, and compliance review workflows.
18. Version and Effective Date
Current Version: v1.0. Effective Date: April 24, 2026. This disclosure may be updated periodically to reflect legal or operational changes. Continued use after publication of an updated disclosure constitutes acknowledgment of the revised version to the extent permitted by law.
